1. Acceptance of Terms
By accessing or using the Bidastra platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including organizations and their authorized team members.
2. Description of Service
Bidastra is an AI-powered tender management platform that helps businesses manage tender submissions. The Service includes AI-powered document extraction, task creation, checklist generation, annexure preparation, digital signature collection, progress tracking, and submission readiness monitoring.
3. User Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any regulations
- Upload malicious content, viruses, or harmful code
- Attempt to gain unauthorized access to the Service or its systems
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to process documents you do not have the right to access
5. Intellectual Property
The Service, including its AI models, design, code, and content, is owned by Bidastra and protected by intellectual property laws. Your tender documents and data remain your property. By uploading documents, you grant us a limited license to process them for providing the Service.
6. Digital Signatures
Bidastra provides digital signature functionality for document workflows. Users are responsible for ensuring that digital signatures collected through the platform comply with applicable laws and organizational policies. Bidastra maintains audit trails for all signature events.
7. AI-Generated Content
The Service uses AI to extract requirements, generate tasks, create annexures, and provide recommendations. While we strive for accuracy, AI-generated content should be reviewed by users before submission. Bidastra is not liable for errors in AI-generated outputs.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance and will provide reasonable notice when possible. We are not liable for any loss resulting from service interruptions.
9. Limitation of Liability
To the maximum extent permitted by law, Bidastra shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.
10. Termination
Either party may terminate the agreement with written notice. Upon termination, your access to the Service will be discontinued. You may request export of your data within 30 days of termination. We reserve the right to suspend or terminate accounts that violate these terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in India.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised terms. We will notify users of material changes via email or platform notification.
